The following text is the first ever translation into English of a writing by German phenomenologist Hermann Schmitz (*1928). In it, Schmitz outlines and defends a non-mentalistic view of emotions as phenomena in interpersonal space in conjunction with a theory of the felt body’s constitutive involvement in human experience. In the first part of the text, Schmitz gives an overview covering some central pieces of his theory as developed, for the most part, in his massive System of (...) Philosophy, published in German in a series of volumes between 1964 and 1980. Schmitz’s System is centred on the claim that the contemporary view of the human subject is the result of a consequential historical process: A reductionist and ‘introjectionist’ objectification of lived experience culminating in the ‘invention’ of the mind (or ‘soul’) as a private, inner realm of subjective experience and in a corresponding ‘grinding down’ of the world of lived experienced to a meagre, value-neutral ‘objective reality’. To counter this intellectualist trend, Schmitz puts to use his approach to phenomenology with the aim of regaining a sensibility for the nuanced realities of lived experience—hoping to make up for what was lost during the development of Western intellectual culture. Since both this text and the overall style of Schmitz’s philosophising are in several ways unusual for a contemporary readership, a brief introduction is provided by philosophers Jan Slaby and Rudolf Owen Müllan, the latter of whom translated Schmitz’s text into English. The introduction emphasises aspects of Schmitz’s philosophy that are likely to be of relevance to contemporary scholars of phenomenological philosophy and to its potential applications in science and society. Frege argued for the force-content distinction not only by appealing to the logical and fictional contexts which are most closely associated with the “Frege point", but also based on the fact that an affirmative answer to a yes-no question constitutes an assertion. Supposedly this is only intelligible if the question contains a forceless thought or proposition which an affirmative answer then asserts. Against this I argue that this fact more readily supports the view that questions operate on assertions and other (...) forceful acts themselves. Force is neither added to propositions as on the traditional view, nor is it cancelled as has recently been proposed. Rather higher-level acts such as questioning, but also e.g. conditionalizing, embed and present assertoric or directive acts that are forceful and committal, while suspending commitment to them. The Frege point confounds different varieties of force and the question whether something is merely presented for consideration with the question what is so presented. Force is representational: through assertoric and directive force indicators subjects non-conceptually present positions of theoretical or practical knowledge, while interrogative acts indicate positions of wondering which strive for such knowledge. Raimo Tuomela’s most important contribution to the philosophy of collective intentionality was his development of the notion of the we-mode. In my chapter I extend the notion of we-mode to that of role-mode, the mode in which individual and collective subjects feel, think and act as occupants of roles within groups and institutional structures. I focus on how being in role-mode is manifest in the minds of subjects and on the following points. First, I argue that both we-mode and role-mode (...) are best thought of as further modifications of I-consciousness, respectively we-consciousness. Second, role-mode is further characterized by the fact that subjects will take positions as role occupants that they won’t take as mere individuals, or we-mode group members, or in other roles. Third, such divergences are only possible against a background of agreements between positions taken in different modes. Fourth, such divergences are also grounded in decision making procedures and the accessibility and admissibility of sources of evidence. Fifth, role-mode goes all the way down, that is, it is also manifest in how subjects feel, move and comport themselves when they occupy their roles. How can people function appropriately and respond normatively in social contexts even if they are not aware of rules governing these contexts? John Searle has rightly criticized a popular way out of this problem by simply asserting that they follow them unconsciously. His alternative explanation is based on his notion of a preintentional, nonrepresentational background. In this paper I criticize this explanation and the underlying account of the background and suggest an alternative explanation of the normativity of elementary social practices (...) and of the background itself. I propose to think of the background as being intentional, but nonconceptual, and of the basic normativity or proto-normativity as being instituted through common sensory-motor-emotional schemata established in the joint interactions of groups. The paper concludes with some reflections on what role this level of collective intentionality and the notion of the background can play in a layered account of the social mind and the ontology of the social world. In this paper I propose three steps to overcome the force-content dichotomy and dispel the Frege point. First, we should ascribe content to force indicators. Through basic assertoric and directive force indicators such as intonation, word order and mood, a subject presents its position of theoretical or practical knowledge of a state of affairs as a fact, as something that is the case, or as a goal, as something to do. Force indicators do not operate on truth- or satisfaction evaluable (...) entities as on the traditional view, but complete and unify them. Second, higher-level acts such as interrogative, logical and fictional acts create higher-level unities that may suspend commitment to the assertions and directions they operate on. But they do not cancel their force, but transfer the meaning of force indicators into the new unities they create. For example, in the context of asking a theoretical or practical question, the assertoric or directive force indicator now presents the kind of knowledge the subject is seeking. Third, the Frege point conflates different varieties of force. We neither need Frege’s assertion sign, nor Hare’s neustic, nor Hanks’s cancellation sign, but only ordinary force indicators and interrogative, logical and fictional markers. Propositions are not forceless contents to which a subject commits by forceful acts, but forceful acts put forward by higher-level acts which may suspend commitment to them. (shrink)

In this paper I criticize theory-biased and overly individualist approaches to understanding others and introduce the PAIR account of joint attention as a pragmatic, affectively charged intentional relation. I argue that this relation obtains in virtue of intentional contents in the minds of the co-attenders, and – against the received understanding of intentional states as propositional attitudes – that we should recognize what I call “subject mode” and “position mode” intentional content. Based on findings from developmental psychology, I propose that (...) subject mode content represents the co-attenders as co-subjects, who are like them and who are at least disposed to act jointly with them. I conclude by arguing that in joint attention we experience and understand affective, actional and perceptual relations at a non-conceptual level prior to the differentiation of mind and body. Among the extensive literature on the first Critique, very few commentators offer a thorough analysis of Kant's conception of inner sense. This is quite surprising since the notion is central to Kant's theoretical philosophy, and it is very difficult to provide a consistent interpretation of this notion. In this paper, I first summarize Kant's claims about inner sense in the Transcendental Aesthetic and show why existing interpretations have been unable to dissolve the tensions arising from the conjunction of these claims. (...) Secondly, I present my own reconstruction of Kant's model of inner sense, relying essentially on Kantian considerations found in the B-version of the Transcendental Deduction. My main idea is that inner sense, for Kant, is a passive faculty that gets affected by the understanding performing its figurative synthesis on material given in outer sense. In the remainder of the paper, I highlight a few consequences of my interpretation and outline ways to deal with some objections. (shrink)

This paper argues that to account for group speech acts, we should adopt a representationalist account of mode / force. Individual and collective subjects do not only represent what they e.g. assert or order. By asserting or ordering they also indicate their theoretical or practical positions towards what they assert or order. The ‘Frege point’ cannot establish the received dichotomy of force and propositional content. On the contrary, only the representationalist account allows a satisfactory response to it. It also allows (...) us to give a more satisfactory analysis of the speech act of inviting a joint commitment and to answer two important questions Bernhard Schmid has raised about group speech acts, namely whether there are 1st person plural forms of Moore’s paradox and of 1st person authority. After outlining why the notion of conscious control of action matters to us and after distinguishing different challenges to that notion, the contribution focuses on the challenge posed by the literature on unconscious goal pursuit. Based on a conceptual clarification of the notion of consciousness, I argue that the understanding of consciousness in that literature is too restricted. The hypothesis that the behaviors reported can be accounted for by nonconceptual forms of consciousness, such as emotions and motor experiences, rather than (...) by—conscious or unconscious—conceptual level intentions tends to be disregarded, even though it promises to be empirically fruitful. The contribution deals with knowledge of what to do, and how, where, when and why to do it, as it is found in a multitude of plans, rules, procedures, maxims, and other instructions. It is argued that while this knowledge is conceptual and propositional, it is still irreducible to theoretical knowledge of what is the case and why it is the case. It is knowledge of goals, of ends and means, rather than of facts. It is knowledge-to that is irreducibly (...) practical in having world to mind direction of fit and the essential function of guiding as yet uncompleted action. While practical knowledge is fundamentally different from theoretical knowledge in terms of mind-world relations, the practical and theoretical domains are still parallel in terms of justificatory and inferential relations, they are like mirror images of one another. It is shown that if this view of practical knowledge is accepted, convincing Gettier cases for practical knowledge can be constructed. An extensive analysis of these cases demonstrates the usefulness of the notions of practical deduction, abduction, and induction. (shrink)

In this paper I outline the PAIR account of joint attention as a perceptual-practical, affectively charged intentional relation. I argue that to explain joint attention we need to leave the received understanding of propositions and propositional attitudes and the picture of content connected to it behind and embrace the notions of subject mode and position mode content. I also explore the relation between joint attention and communication.

How can the law be characterized in a theory of collective intentionality that treats collective intentionality as essentially layered and tries to understand these layers in terms of the structure and the format of the representations involved? And can such a theory of collective intentionality open up new perspectives on the law and shed new light on traditional questions of legal philosophy? As a philosopher of collective intentionality who is new to legal philosophy, I want to begin exploring these questions (...) in this paper. I will try to characterize the law in terms of the layered account of collective intentionality that I have introduced in some earlier writings (Schmitz 2013; 2018). In the light of this account I will then discuss a traditional question in the philosophy of law: the relation between law and morality. I begin by giving a brief sketch of the layered account in the next section. Collective intentionality should be understood in terms of experiencing and representing others as co-subjects, rather than as objects, of intentional states and acts on different layers or levels. I distinguish the nonconceptual layer of the joint sensory-motor-emotional intentionality of joint attention and joint bodily action, the conceptual level of shared we-mode beliefs, intentions, obligations, values, and so on, and the institutional level characterized through role differentiation, positions taken in role-mode, e.g. as a judge or attorney, and writing and other forms of documentation. In the third section I introduce a set of parameters for representations such as their degree of richness, of context-dependence, of density and differentiation of representational role and of durability and stability, which can be used to more precisely distinguish different layers. I also put forward the hypothesis that these properties are connected and tend to cluster, and that higher levels can only function and determine conditions of satisfaction against lower level ones. In the fourth and final section I critically discuss the sharp positivistic separation of morality and the law according to which whether something is a law is completely independent of its moral merits. I argue that this only seems plausible if we take an observational stance towards the law, but not towards morality. When we treat them the same way, it rather appears that the moral attitudes of the co-subjects of a society will determine whether and to what extent they will accept its legal order. I conclude by proposing to think of the law as being itself an institutionalized form of morality. (shrink)

In the absence of pre‐established communicative conventions, people create novel communication systems to successfully coordinate their actions toward a joint goal. In this study, we address two types of such novel communication systems: sensorimotor communication, where the kinematics of instrumental actions are systematically modulated, versus symbolic communication. We ask which of the two systems co‐actors preferentially create when aiming to communicate about hidden object properties such as weight. The results of three experiments consistently show that actors who knew the weight (...) of an object transmitted this weight information to their uninformed co‐actors by systematically modulating their instrumental actions, grasping objects of particular weights at particular heights. This preference for sensorimotor communication was reduced in a fourth experiment where co‐actors could communicate with weight‐related symbols. Our findings demonstrate that the use of sensorimotor communication extends beyond the communication of spatial locations to non‐spatial, hidden object properties. (shrink)

For it is a remarkable book, frequently brilliant, sometimes dazzling, often original, more often still, troubling. Troubling, not so much by its conclusions as by the (...) means used to arrive at them, and the implications suggested by those means. The book begins with phenomenology, passes on to ontology in the Heideggerian vein, and culminates in a theology of agapic love. I almost wrote that it passes through Heideggerian ontology to agape, but that is what is most troubling about the book. One puts it down wondering, despite critical reassurances from the author, whether the analysis has ever freed itself from the shaping hand of Heideggerian ontology, or has done so at too high a cost. It is not that the author accepts Heidegger; indeed his critical exegesis is perhaps the most brilliant part of a very striking book. But nonetheless, Heidegger's stamp is so heavy upon the analysis, his presuppositions so ingrained in it, that the conclusions themselves, while expressly "beyond" Heidegger, nevertheless trail his ontology in their train. In a preface written nearly ten years after the French book first appeared, Marion reassures his English readers (perhaps with a touch of unintended condescension) that God exists. There can be no doubt, too, that his exegesis often opens up surprising senses of the Biblical texts, such as those of the Wisdom literature in the Old Testament and the letters of St. Paul in the New. The first chapter carries out a phenomenology of the difference between the idol and the icon. The idol is not false or illusory in any ordinary sense. On the contrary, its luminescence is an actual reflection of the divine. The fulguration catches the human eye, mind and spirit as it gazes at the embodied manifestation in wonder. But, instead of letting the fulguration measure the import of the disclosure, the gaze stops at the luminous idol and freezes the divine light within the scope of the worshipper's merely human gaze, interest and aim. The aim, then, provides the measure and meaning of the light, referring it back to the human intention. And so the idol divides the fulguration, retaining for the gaze what is so extraordinarily visible, while it lets go what is unattainable through its effort and on its own terms. Marion expresses this remainder by the neologism: invisable, from viser: to aim. We have here an initial insistence upon the inability to reduce God to a concept. The analysis exposes the logic of a first level of idolatry, idolatry which takes form as the regionalization of the divine. Thus, to choose a portentous example, Nietzsche unmasks the regional " God of morality" proclaimed by Kant and other modern thinkers. It is quite the reverse with the icon. The luminosity of the icon presents its visage to the believer who receives it as the face that endows the visible with the inexhaustible invisibility of God. It is of signal importance to Marion's thesis, however, that the invisible is not thereby offered to human sight or conception, but rather that the visible features of the icon ask to be transgressed, giving way-neither to the sight of sense or mind-but to veneration ( 19). The closure of our public life to the transcendent dimensions of human existence. For esteemed philosopher Kenneth Schmitz these are the by-products of modernity and post-modernity. But The Recovery of Wonder is not a denunciation of modern philosophy. Instead, it seeks to point out what needs to be rethought at fundamental levels of our understanding and to show clearly how contemporary social concerns can (...) be illuminated by a new look at the history of philosophy. While acknowledging the significant gains modernity and post-modernity offer Western civilization in the areas of liberty and knowledge, Schmitz sees in their arguments a superficiality that does not "bite to the bone." The Frege point to the effect that e.g. the clauses of conditionals are not asserted and therefore cannot be assertions is often taken to establish a dichotomy between the content of a speech act, which is propositional and belongs to logic and semantics, and its force, which belongs to pragmatics. Recently this dichotomy has been questioned by philosophers such as Peter Hanks and Francois Recanati, who propose act-theoretic accounts of propositions, argue that we can’t account for propositional unity independently of (...) the forceful acts of speakers, and respond to the Frege point by appealing to a notion of force cancellation. I argue that the notion of force cancellation is faced with a dilemma and offer an alternative response to the Frege point, which extends the act-theoretic account to logical acts such as conditionalizing or disjoining. Such higher-level acts allow us to present forceful acts while suspending commitment to them. In connecting them, a subject rather commits to an affirmation function of such acts. In contrast, the Frege point confuses a lack of commitment to what is put forward with a lack of commitment or force in what is put forward. (shrink)

The distinction between the force/mode of speech acts and intentional states and their propositional content has been a central feature of analytic philosophy since Gottlob Frege and Bertrand Russell. In this introduction we present the distinction and its motivation and review some recent challenges to it that appeal to the problem of the unity of the proposition, in order to give the reader a sense of the current state of debate to which the contributions of this volume respond.

Evolution has become the standard way of understanding the world process. Theology has to express traditional faith in the context of the contemporary world. Since the common world view has profoundly changed, from a static world of being into a dynamic world of becoming, theology needs to change its language and its understanding of the universe as God's creation. This understanding of an evolving world is to be used as a theological source. Such a change of perspective necessitates a fundamental (...) reconstructing of theology; for theology, such reconstructing means a renewed understanding of the Creator and of the Incarnation. First of all, this paper aims at a clarification of Wittgenstein's conception of grammatical propositions. Their essential characteristics will be developed and some of the central questions concerning their status will be discussed: Should grammatical propositions be seen as arbitrary conventions? How do they work in practices? And how do they relate to natural facts? Later on, the two propositions "Every rod has a length" and "Sensations are private" will be discussed in more detail, for both fulfil three important features (...) of grammatical propositions: They are not empirical descriptions, they are rules of a practice, and they are not knowledge-claims but express insights. Focussing on the grammar of pain language, it will be shown what kind of interdependency exists between grammar and natural facts. It will also turn out that some grammatical propositions are closely connected to our understanding of living a human form of life. (shrink)

The age–old dilemma of free will and determinism is attacked by proving that both sides are flawed with contingencies, that the notion of eternal law is a theologically tainted projection rather than a reality of the real world that is understood to be evolutionary. Determinism is dissolved into conditionalism. This excludes materialistic scientific explanation of the deterministic style. As it brings forth freedom, evolutionary reality transcends essentially the explanatory possibilities of statistically structured natural laws. The dilemma of determinism and free (...) will based on a logic of contradiction is replaced by an ontology of polarity. (shrink)

The Oxford English Dictionary says that a rite is ‘a formal procedure or act in a religious or other solemn observance’. The word comes into English through the French rite from the Latin ritus . Its original meaning escapes etymologists; and this is a mixed blessing, for we neither can nor must attempt a retrieval of its hidden roots. We are told by respectable etymologists that the word is associated from earliest times with Latin religious usage, but that even in (...) the early Latin it was already extended to ‘custom, usage, manner or way’ of a non-religious sort. [Lewis and Short, A Latin Dictionary .] So, too, in modern languages the terms ‘rite’ and ‘ritual’ have specifically religious meaning, but they are also used in social and cultural settings that we would not call religious. What first strikes us about the terms ’ and ‘ritual’ is an emphasis upon a certain formality, upon a regular and stable way in which an action or set of actions is to be performed. A ritual is more than a formalism, however, since there are formalisms that are not rites, such as the logical rules for making a valid argument. Moreover, the term is frequently associated with the terms ‘myth’, ‘symbol’ and ‘faith’. These, too, are primarily religious, but are also extended to non-religious contexts. Indeed, there seems to be a network of such terms whose usage touches upon some extraordinary quality in things. Like them, the term ‘ritual’ shares both a wide variety of meanings and a certain hint of impropriety. The variety of ritual forms is notorious, ranging from the most sacred religious liturgies to the absurdities of a fraternity initiation; and the impropriety of the term breaks out whenever we brand a certain action ‘ritualistic’, just as we sometimes refer slightingly to an assertion, saying it is ‘mythical’, ‘merely symbolic’ or ‘credulous’. How can consciousness, how can the mind be causally efficacious in a world which seems—in some sense—to be thoroughly governed by physical causality? Mental causation has been a nagging problem in philosophy since the beginning of the modern age, when, inspired by the rise of physics, a metaphysical picture became dominant according to which the manifest macrophysical world of rocks, trees, colors, sounds etc. could be eliminated in favor of, or identified with, the microconstituents of these entities and their basic (...) physical properties, plus their effects on human or animal minds. Against the background of this ontology, the argument from causal closure, or the causal completeness of physics, exerts strong pressure to also identify consciousness with microphysical entities—or even to eliminate it in favor of the latter—the only other options apparently being either the denial of the causal closure of the physical level, epiphenomenalism about the mind, or the view that its physical effects are generally overdetermined. In this paper, however, I want to introduce what I call the “microstructure view” (MV) of the brain-consciousness relation, and I want to try to make plausible that the problem of mental causation can also be solved, or perhaps rather dissolved, on the basis of this account. On the MV, the minimal neuronal correlates of consciousness—of the global state of consciousness, or specific states of consciousness such as pain—are not identical with these states, but rather constitute their microstructure, or, as I shall also say, equivalently, compose them. Ideas about heredity and evolution are undergoing a revolutionary change. New findings in molecular biology challenge the gene-centered version of Darwinian theory according to which adaptation occurs only through natural selection of chance DNA variations. In Evolution in Four Dimensions, Eva Jablonka and Marion Lamb argue that there is more to heredity than genes. They trace four "dimensions" in evolution -- four inheritance systems that play a role in evolution: genetic, epigenetic, behavioral, and symbolic. These systems, they argue, can all (...) provide variations on which natural selection can act. Evolution in Four Dimensions offers a richer, more complex view of evolution than the gene-based, one-dimensional view held by many today. The new synthesis advanced by Jablonka and Lamb makes clear that induced and acquired changes also play a role in evolution.After discussing each of the four inheritance systems in detail, Jablonka and Lamb "put Humpty Dumpty together again" by showing how all of these systems interact. They consider how each may have originated and guided evolutionary history and they discuss the social and philosophical implications of the four-dimensional view of evolution. Each chapter ends with a dialogue in which the authors engage the contrarieties of the fictional "I.M.," or Ifcha Mistabra -- Aramaic for "the opposite conjecture" -- refining their arguments against I.M.'s vigorous counterarguments. Harry S. Broudy has studied the utility of general education through the development and testing of his Newspaper Test of the Uses of Schooling (NPT). The results of research with a new version of the NPT are reported in this essay and some options for future research are presented. The results of the study indicate that continued development and testing of the NPT will prove important. Promising new versions of the test are suggested for future research to pursue, including a (...) Hypertest version. Additional instruments and research strategies are also suggested that could be used to broaden the "search for evidence" of the uses of schooling. (shrink)

The impossibility of predicting the future allows us only to indicate which theological developments seem to be needed. These developments concern our changing perception of the world, which requires a reversal in our understanding of God's Creation, from its most imperfect beginnings to its unforeseeable future. The passing of evolution from the biological to the human level has opened moral dimensions that must be explored. Rather than return to the beginnings of the church, theology needs to try to understand Christian (...) faith within evolution, to reinterpret the past in the light of the new. In evolution, no final doctrine is possible. The necessity for doctrine creates a constant tension with the necessity of its revision. New truth must be paid for by suffering. The need is for a coherent theological vision of Creation, Redemption, and God's action in the world. Teilhard's metaphysics of union may be the key to it. In this view love becomes the central force of creation, which in Teilhard's view opens into an eternal future in God: in its final stage, evolution becomes Christogenesis. (shrink)

Eva Picardi has been one of the most influential Italian analytic philosophers of her generation. She taught for forty years at the University of Bologna, raising three generations of students. This collection of selected writings honors her work, confirming Picardi's status as one of the most important Frege scholars of her generation and a leading authority on the philosophy of Donald Davidson. Bringing together Picardi's contributions to the history of analytic philosophy, it includes her papers on major 20th-century figures such (...) as Wittgenstein, Quine, Davidson, Rorty, and Brandom. She examines their work in comparison with the philosopher Michael Dummett's, illuminating contrasts between American Neo-pragmatism and Continental philosophy. By considering key contributions made by Gadamer and Adorno and contrasting them with Davidson and Rorty's proposals, Picardi is able to bridge the Analytic and Continental divide. Featuring an introduction by Annalisa Coliva and new translations of previously unpublished papers, this collection emphasizes the significance of Picardi's work for a new generation of readers. The transference is destined to be dissolved at the end of the analysis. It is true that psychoanalysis, in its technique, harbours serious problems; its essential « travail » , however, is to promote the transformation that a person realizes through his/her own creative word that pushes him/her to give birth to him/herself. Coming from Germany in Europe I am starting with Feminism from a Western point of view but with a perspective of dialogue with Feminisms in other parts of the World. My inquiry deals with problems of the present time, especially how to make Feminism interesting not only to a philosophical or academic public, but to people from all professional fields and disciplines. The political perspective of feminist philosophy can be underlined with the central definition the Austrian philosopher Herta Nagl Docekal (...) gives. According to this definition freedom of women is the main issue of each feminist interrogation. With regard to the development of women’s liberation in Europe and the USA three different movements of feminism can be distinguished: the main issue of the first is the notion of equality, it is also called humanist feminism according to Iris Marion Young; secondly we have the feminism of difference or gynocentrism; the third wave can not so easily be defined, a wide range of variety exists, which may lead to the impression that no more general aim is left. Sometimes it is also called postmodern feminism. But what does this mean: postmodern feminism? Far from an arbitrary attitude, which does not accept any order, postmodern feminism – as postmodern and poststructural philosophy – may be understood as a lesson on how to be different and not to loose the aims women share all over the world. The most important challenge is to find a new balance between the different aims and groups of feminism as well as between feminism in different societies and cultures. Feminisms from the beginnings wanted to overcome step by step the prejudices about men and women, about sex and gender, one of the heritages of our Western tradition. My interpretation of Third Wave may be seen as another step on this way. (shrink)

Ranging from Plato to Marx, one can only find a few philosophers who have talked about money without detesting it. Naturally, economists are avoiding such an attitude. But they deliver only functional definitions, nothing which could give a hint at the essence of money. The essay tries to clarify it by delineating a currency as an ‘ens ficitivum’ – created by our semiotic activities, which have been analysed by Charles Sanders Peirce. Discussing some aspects of Carl Schmitt’s, Chantal Mouffe’s, Paul Ricoeur’s, and Jacques Rancière’s political theories the paper tries to determine the proper subject of political and social philosophy. To that end the author constructs two terminological oppositions: ‚the social’ versus ‘the society’, ‘the political’ versus ‘politics’. These four nouns form a terminological square which marks the social and the political difference. The social appears when underprivileged people demand a redistribution of wealth and influence, i. e. a reconstruction of a given (...) society. The political emerges when the hidden normative framework of politics comes into vie. Confronting the social and the political difference in this way makes it possible to determine: politics are the matter of the political sciences, the difference between politics and the political, conversely, is the theme of political philosophy; society is the subject of sociology, the difference between the social and any form of society, however, is the issue of social philosophy. Genetic testing practices are increasingly advancing clinical medicine. This process of ‘routinisation of genetics’ has been conceived as a medical and ethical problem mainly because of the assumption that non-geneticists might lack the necessary skills to provide these services. In particular, the relevant theoretical knowledge in clinical genetics is viewed as insufficient in general practitioners and physicians from other specialities. Empirical findings seem to indicate significant variations not only in theoretical but also in practical knowledge between geneticists and non-geneticists. Several (...) fields of practical knowledge—regarding for example the focus of clinical action, the relevance of therapeutic action or the normative framework—can be identified that are or could be areas of conflict when the routinisation of genetic services proceeds. From an ethical point of view, these variations in know how and background are especially relevant whenever the respective genetic service is concerned with medical information of exceptional normative quality, such as, for example, in prenatal genetic screening and diagnosis of untreatable conditions. Here, the clinically acquired practical knowledge of the non-geneticist could be particularly misleading insofar as there is no relation to therapy and—in a narrow sense—no clinical utility to be assessed. Non-geneticists need a chance to acquire the relevant theoretical and practical knowledge in order to understand and fulfil their own duties in the respective situations in a way that secures the important rights at stake of their patients and clients. Epigram 5.67 derives its point from Martial's critical and creative way of dealing with the mythical tradition. After he has described from the swallows' perspective an incident that occurred in the avian world, in the last distich the point of view undergoes a surprising shift from the victim to the agent. This is effected by a smooth transition from the swallow that has been cruelly torn to bits by its own kind to the mythical Procne, who tore her son to (...) bits and suffered the punishment of being changed into a swallow. The aetiology that forms the concluding point of the epigram shows the incident in a new light. The nature of swallows is marked once and for all by Procne's behavior: as she once tore Itys to pieces, so the swallows of our epigram behave; indeed, at the very beginning they are pointedly designated as Attbides. The narrator's concluding comment that the guilty mother ought to have been torn to bits immediately after her impious act is an attempt, albeit a vain one, to correct the myth. (shrink)

The history of philosophy provides examples of attempts to vindicate the adequation of thought with being. Thought has sometimes armed itself in the Cartesian manner with criteria for measuring its own conformity with being. But such an immediate and direct appeal to "pure" thought rests inescapably upon a tacit appeal to a human experience which includes sensible factors; and so it begs the question. Moreover, it seems to me that all attempts fail which try to join the knower and the (...) known by putting the idea or judgment between them. For whether the intervention is by criterion, instrument, or method, it merely complicates the problem of their union by adding a useless intermediary. Indeed, in the face of the idealism of Descartes and Locke, and within the presuppositions of a theory of noetic species, modern scholastics were right to insist upon the "non-entity" of ideas and judgments. They insisted that a noetic principle, such as an idea or judgment, is nothing in itself but a pure sign, and that it is not an object which, while signifying something else, also exists in its own right as a mental entity. In trying to account for the concrete unity of language and cognition—which I may be forgiven for calling "linguo-knowledge"—there is much to recommend a theory of signs which differentiates knowledge-signs from all other kinds. It is an attempt to do justice to the quasi-instrumental features of linguo-knowledge, while at the same time keeping before us its radical ontological openness. Nothing intervenes between knowing and being, least of all the "equipment" of knowing, its ideas and judgments. The relationship between language and knowledge, however, would have to be determined more precisely since linguistic signs lend themselves to being considered as odd sorts of instruments, and by some linguists even as entities. Nevertheless, although linguistic signs are inseparable in concreto from noetic signs, it remains true that noetic signs are non-entitative, for there is a fundamental sense in which knowing is not an affair of entities or instruments at all. The essential possibility of knowledge lies in what has traditionally been called its immateriality and even its spirituality. (shrink)

In the paper author discusses ideas of L. Wittgenstein who renounced formalism which was characteristic of the "Tractatus" epoch. The change is connected with the adoption of a different conception of language which refers, among other, problems to the new approach to "generality" (e.g. to generalized sentences). Wittgenstein rejected the proposition of analytical reductionism which is a conviction that it is possible to reduce and analyse "generality". He changed his opinion connected with the theory of meaning. The problems discussed above, (...) dealt with by earlier conceptions of Frege and Russell belong to important problems of the philosophy of logic and the philosophy of language. (shrink)

The paper tries to contribute to the discussion of the following problem: Nearly every government acts as if it has a natural right to collect taxes – if necessary by force. How legitimate is such an act of expropriation? To find an acceptable solution, three different theories of property are discussed – eventually favouring the Kantian approach. Subsequently, possible vindications of taxation are presented: (1) control of conduct, (2) financing public institutions, (3) reduction of social differences. All three justifications turn (...) out to be de ficient. What remains is John St. Mill's almost forgotten theory; he sees taxes as a sacrifice and, on this account, pleads for a proportional taxation. (shrink)

The adultery tale of the lover in the vat in Apuleius’ „Metamorphoses“ 9.5-7 is a farcial narrative of everyday life, which still allows its reader to recognize the narrative structure of an underlying literary model. In this embedded tale Apuleius presents a modernized version of the famous story of Venus committing adultery with Mars by transferring his characters into the social environment of poor commoners. By means of specific signals the audience is pointed towards the well-known constellation of the famous (...) case of adultery among the gods. The new narrative still carries vestiges of the mythical precedent, in the light of which the narrator’s (Lucius-ass) merry tale about a cuckolded husband can be read. Although the characters of the novel differ considerably from the prototypes of the myth repeatedly adapted in literature, its narrative structure nevertheless remains recognizable as a foil. If we accept the idea that the value of a “logic” depends on its ability to fit the usual meaning of the “logical constants” which it formalises and the inferences we draw on their basis, we may ask if the meaning of “possible” is well captured by normal modal logic. We are faced with the following puzzle: if is meaningful and non contradictory is it not a logical truth that ? First, it is shown why there is no logical law (...) of the form , being a neutral wff, and then some philosophical conclusions are drawn: “possible” relative to truth must be distinguished from possible “relative” to meaning, and the former only is formalised in modal logic. METAPHYSICS is the most controversial and controverted of the philosophical disciplines. I want to argue, nevertheless, that if it did not already exist in some form, then it would be necessary to invent it. For the need to think fundamentally is not incidental to the inquiring energy of the human mind. That energy has taken form as myth, meditation, and reflection among a variety of peoples of diverse cultures. In our rather abstract and articulate culture, however, fundamental thinking has taken (...) the rational, argumentative and conceptual form of discourse. (shrink)

Teilhard's texts were published in two complementary publications, the more philosophical‐theological ones in the L'Oeuvres (OV), the scientific ones in the L'Oeuvre Scientifique (OS)1. His letters were published in a nonsystematic way. The publication of the Oeuvres presented thematic compilations. The papers had their own production history, creating different versions. Scientific texts were published by Teilhard in widely dispersed journals and have been collected into L'Oeuvre Scientifique. The scientific status of Teilhard is related to his positions in the scientific world (...) and the continued use of his publications. The influences causing different versions of theological and philosophical papers are analyzed. The present accessibility of the diaries and their importance for a full understanding of Teilhard is elaborated. (shrink)

THE THEME, "The Intelligibility of Nature," is exceedingly broad. It stretches like a vast domain in which one can only hope to leave a few footprints, some fragile impressions that are all but lost in the expanse. In attempting to understand the natural world, the enterprise that is most familiar to many of us is inherited from the Greeks and their Latin heirs, both classical and mediaeval, and this enterprise continues in our own day in the form of the modern (...) sciences of nature. Nowadays, we are more informed about the knowledge acquired by the Egyptians, Babylonians, and others prior to the Greeks. We are more conscious of the achievements of the Chinese in physics and the Indians in mathematics. And we are more aware of the medical and zoological lore present in oral traditions, such as those of Africa. Moreover, we are only now beginning to appreciate their contributions and their potential for new forms of enquiry, including other ways of approaching nature. The terms in which the topic is here designated, however, are conceived in Greek and expressed in Latin. Nevertheless, even within this cultural tradition of natural enquiry, the topic is quite broad enough. Like a grammarian of old parsing a sentence, I am forced to begin by distinguishing parts of the theme. (shrink)

THIS ESSAY was originally prepared for the 1988 Metaphysical Society Meeting, where I had been asked to speak out of what has been called "the great tradition," concerning the rumored "end of metaphysics." It is important, however, to notice what followed the colon in the chosen theme: "the question of foundations." For metaphysics has been pronounced dead several times already, according to different autopsies: by scepticism, nominalism, empiricism, and by at least two versions of positivism, the one prescribed by Auguste (...) Comte and the other more recently mandated by the Vienna Circle. Indeed, death notices of metaphysics have become traditional in "the great tradition" itself; so that these recurrent obituaries disclose something of the very nature of metaphysics. While several of these morbid diagnoses continue to play a role-since in these matters nothing ever seems to quite wholly die once it gets itself born--there is a new angel of death on the scene. It is Nietzsche, purged of the metaphysics that had allegedly infected him, a revisionist or at least a revised Nietzsche, a neo-Nietzsche who has rallied an impressive number of lively mourners to the wake. Should the notices prove premature, however, the question will then resolve itself into: "Who will bury whom?". (shrink)

It is said of St. Thomas Aquinas’ teacher, St. Albert the Great, that he grew forgetful towards the end of his life and began to say mass for himself as though he were dead: quasi defunctus est. The fact that he was one of the most learned persons of Western Europe during his life-time did not save him from a pathetic loss of memory. The story illustrates a bitter knowledge known from time immemorial: that age may steal away one’s innermost (...) possessions. Of course, it has always been known too that a blow upon the head in the prime of life may rob a person of consciousness and leave him or her permanently impaired. To this general wisdom about the fragility of conscious life, researchers have lately added an increasingly complex and precise knowledge of just how the brain and its various regions participate in our conscious life. So that this new detailed knowledge fills out the ancient recognition of the soul’s reliance upon its physical base; it gives new weight to that dependence, and confirms the human spirit’s immersion in matter. And if it does not quite overwhelm us with the intimacy of the alliance between soul and body, it bids fair to change the tone and degree of our awareness of that connection, so that the claim to the soul’s immortality is likely nowadays to fall upon less receptive ears. Indeed, talk about the soul sounds strange to the ears of many present-day psychologists and philosophers. And even Christian theologians write copiously today about the resurrection of Christ and of the dead, but little about the immortality of the soul. (shrink)
